LA County to pay $400,000 to settle with San Fernando Valley church that defied coronavirus orders

A legal battle between Los Angeles County, the state and a Sun Valley church that repeatedly flouted health restrictions during the COVID-19 pandemic could be coming to an end, with the county Board of Supervisors being asked next week to approve a $400,000 payment to the church to settle the case.

According to a county staff report, the settlement calls for the state to pay an additional $400,000 to resolve the litigation with Grace Community Church. The report, first obtained by KNX Newsradio, indicates that the county has already spent more than $950,000 in attorneys fees and other costs related to the legal battle with the church.

The church, led by Pastor John MacArthur, repeatedly defied county health orders over the past year, most notably by continuing to hold indoor services despite a ban on such gatherings, while also refusing to enforce mask-wearing and social-distancing requirements for church-goers.

County health officials repeatedly cited the church, then took the matter to court to obtain an injunction requiring the church to adhere to health regulations, saying they were essential to control the spread of COVID-19. The church, meanwhile, sued the state and the county, claiming the COVID rules amounted to constitutional violations of religious freedom.

Last September, Los Angeles Superior Court Judge Mitchell L. Beckloff issued a preliminary injunction sought by the county, but the church essentially ignored it, continuing to hold indoor services and violating other health mandates. That led county attorneys to seek a contempt ruling against the church.

Grace Community Church attorneys fought back, filing a motion to have the injunction lifted and the contempt request dismissed, citing two U.S. Supreme Court decisions. In one, a Catholic diocese and a group of Jewish synagogues successfully challenged New York's restrictions on churches. The high court later struck down the indoor worship ban while allowing caps on attendance and a ban on singing, according to the church's attorneys.

Putin has banned forcing Russians to get vaccinated and firing them for refusing to get vaccinated. President Vladimir Putin has declared that mandatory vaccinations will never be allowed because Russia is a free country and its people are sovereign.

“No one should be forced to get a jab. Pressure, where people may lose their jobs, is NOT acceptable,” Putin said during a recent speech.

Putin said Wednesday that some 23 million Russians had received the jab and said the country’s homegrown vaccines were better than foreign alternatives, naming AstraZeneca and Pfizer.

“We are doing fine,” he said.

The 68-year-old leader also addressed widespread vaccine skepticism in the country and urged Russians to listen to “specialists.”

“It is necessary to listen, not to people who understand little about this and spread rumors, but to specialists,” he told Russians, the majority of whom polls show oppose receiving coronavirus jabs.

Putin has in recent months urged Russians to get vaccinated and announced earlier this year he had got the jab, without specifying which one of the country’s four vaccines he had received.

On Wednesday he announced he was inoculated with Sputnik V, the first vaccine registered in Russia.

Officials have been accused of underreporting fatalities, counting only cases when coronavirus was found to be the primary cause of death after autopsy.

Authorities on Tuesday reported 652 coronavirus fatalities, topping a record that was set in December last year.

VAERS Database Reports 623,343 Adverse Side Effects From Vaccine

When reviewing data from VAERS, please keep in mind the following limitations I can be 10 to 100 times underreported. 

VAERS is a passive reporting system, meaning that reports about adverse events are not automatically collected, but require a report to be filed to VAERS. VAERS reports can be submitted voluntarily by anyone, including healthcare providers, patients, or family members. Reports vary in quality and completeness. They often lack details and sometimes can have information that contains errors.

"Underreporting" is one of the main limitations of passive surveillance systems, including VAERS. The term, underreporting refers to the fact that VAERS receives reports for only a small fraction of actual adverse events. The degree of underreporting varies widely. As an example, a great many of the millions of vaccinations administered each year by injection cause soreness, but relatively few of these episodes lead to a VAERS report. Physicians and patients understand that minor side effects of vaccinations often include this kind of discomfort, as well as low fevers. On the other hand, more serious and unexpected medical events are probably more likely to be reported than minor ones, especially when they occur soon after vaccination, even if they may be coincidental and related to other causes.

A report to VAERS generally does not prove that the identified vaccine(s) caused the adverse event described. It only confirms that the reported event occurred sometime after vaccine was given. No proof that the event was caused by the vaccine is required in order for VAERS to accept the report. VAERS accepts all reports without judging whether the event was caused by the vaccine.

Data released today by the Centers for Disease Control and Prevention (CDC) showed that between Dec. 14, 2020 and Aug. 20, 2021, a total of 623,343 total adverse events were reported to VAERS, including 13,627 deaths — an increase of 559 over the data released last week.

There were 84,466 reports of serious injuries, including deaths, during the same time period — up 3,416 compared with the previous week.

Excluding “foreign reports” filed in VAERS, 488,318 adverse events, including 6,128 deaths and 38,765 serious injuries, were reported in the U.S. between Dec. 14, 2020 and Aug. 20, 2021.between Dec. 14, 2020 and Aug. 20, 2021.

Of the 6,128 U.S. deaths reported as of Aug. 20, 13% occurred within 24 hours of vaccination, 18% occurred within 48 hours of vaccination and 32% occurred in people who experienced an onset of symptoms within 48 hours of being vaccinated.

In the U.S., 360.3 million COVID vaccine doses had been administered as of Aug. 20. This includes: 203 million doses of Pfizer, 143 million doses of Moderna and 14 million doses of the Johnson & Johnson (J&J).

The data come directly from reports submitted to the Vaccine Adverse Event Reporting System (VAERS), the primary government-funded system for reporting adverse vaccine reactions in the U.S.

Every Friday, VAERS makes public all vaccine injury reports received as of a specified date, usually about a week prior to the release date. Reports submitted to VAERS require further investigation before a causal relationship can be confirmed.

As COVID surges among fully vaccinated, CDC fails to properly track breakthrough cases

As The Defender reported Aug. 24, the most recent data from the CDC shows 9,716 breakthrough cases resulting in hospitalization or death as of Aug. 16. However, the agency states those numbers are underreported.

On May 1, the CDC made a decision to stop tracking all breakthrough cases and instead only track cases in the fully vaccinated that resulted in hospitalization or death. That leaves public health officials without the full data that can answer questions as the new Delta variant spreads.

In an interview with PBS News Hour, Jessica Malaty Rivera, an infectious disease epidemiologist and research fellow at Boston Children’s Hospital and former science communications lead at the COVID Tracking Project, said not tracking breakthrough data with as much granularity as we would hope is “basically creating blind spots in our understanding of the true impact of the virus, especially the variants that are circulating so widely in the United States.”

The New York Times recently published data from seven states — California, Colorado, Massachusetts, Oregon, Utah, Vermont  and Virginia — that keeps particularly detailed records on breakthrough cases.

Analysis showed that in six of the states, breakthrough infections made up 18% to 28% of all newly diagnosed cases of COVID in the past several weeks, and 12% to 24% of all COVID-related hospitalizations, with reported deaths higher than the CDC’s original estimate of .5%.

New Israeli Study Finds Fully Vaccinated People are at “Greater Risk of Hospitalization” and 13 TIMES MORE LIKELY to Catch Covid-19 Than Those Who Have Recovered and Have Natural Immunity

The study was described by Bloomberg as "the largest real-world analysis comparing natural immunity - gained from an earlier infection - to the protection provided by one of the most potent vaccines currently in use." A few days ago, we noted how remarkable it was that the mainstream press was finally giving voice to scientists to criticize President Biden's push to start doling out booster jabs. Well, this study further questions the credibility of relying on vaccines, given that the study showed that the vaccinated were ultimately 13x as likely to be infected as those who were infected previously, and 27x more likely to be symptomatic.

This should feel like vindication for those who are being extorted into getting the vaccine even though you have natural antibodies and likely immunity to coronavirus. 

A new study out of Israel has seemingly confirmed that individuals who have natural immunity have better protection against the NEW DELTA VARIANT than people who are fully vaccinated.

The team of researchers, from Maccabi Healthcare and Tel Aviv University, published their study earlier this week to medRxiv.org.

‘This study demonstrated that natural immunity confers longer-lasting and stronger protection against infection, symptomatic disease and hospitalization caused by the Delta variant of SARS-CoV-2, ‘ the team of researchers wrote. 

Not just a little bit better either. People who have taken both doses of the Pfizer jab are 13 TIMES more likely to have a breakthrough infection, and are even at a “greater risk for Covid-19 hospitalizations.”

The researchers conducted an extensive study on 800,000 individuals that were broken into 3 groups. People who had received either one or two doses of the Pfizer-BioNTech COVID-19 vaccine were compared with unvaccinated individuals who have natural immunity, because they had already recovered from the virus.

SARS-CoV-2-naïve vaccinees had a 13.06-fold (95% CI, 8.08 to 21.11) increased risk for breakthrough infection with the Delta variant compared to those previously infected, when the first event (infection or vaccination) occurred during January and February of 2021. The increased risk was significant (P<0.001) for symptomatic disease as well. 

When allowing the infection to occur at any time before vaccination (from March 2020 to February 2021), evidence of waning natural immunity was demonstrated, though SARS-CoV-2 naïve vaccinees had a 5.96-fold (95% CI, 4.85 to 7.33) increased risk for breakthrough infection and a 7.13-fold (95% CI, 5.51 to 9.21) increased risk for symptomatic disease. SARS-CoV-2-naïve vaccinees were also at a greater risk for COVID-19-related-hospitalizations compared to those that were previously infected.

MOST NOTABLY, the study also found – Three months after a 2nd dose, the risk of contracting Covid was 13.06 times higher among the vaccinated and they are 27 TIMES more likely to experience symptoms.

After adjusting for comorbidities, we found a 27.02-fold risk (95% CI, 12.7 to 57.5) for symptomatic breakthrough infection as opposed to symptomatic reinfection (P<0.001) (Table 2b). None of the covariates were significant, except for age ≥60 years. 

So, to get this straight – According to these highly credible researchers who conducted a massive study on hundreds of thousands of people, the Pfizer-BioNTech vaccine won’t just make people more likely to catch new variants – they will also be more affected by symptoms and more likely to end up hospitalized.

This latest data just adds to a mounting pile of evidence that demonstrates the experimental jab’s low efficacy when it comes to stopping the spread of the virus. Even before this most recent study, some researchers had already found that the vaccinated spread the virus as much, if not more, than the unvaxxed.

Japan Suspends Use of 1.63 million Moderna Vaccines

Japan on Thursday suspended the use of 1.63 million doses here shipped to 863 vaccination centers nationwide, more than a week after the domestic distributor, Takeda Pharmaceutical, received reports of contaminants in some vials.

The contaminant found in a batch delivered to Japan is believed to be a metallic particle, Japanese public broadcaster NHK reported, citing health ministry sources.

The European Union drugs regulator said it was investigating the incident at the Spanish plant run by Rovi, but did not find reasons to seek a temporary suspension of production after an initial assessment.

“COVID-19 vaccine production in Rovi is able to continue, following a preliminary risk assessment,” the European Medicines Agency told Reuters in a statement.

“An investigation into the root cause is ongoing. EMA will be able to provide more information as the investigation progresses,” it added.

Moderna has so far delivered to the EU nearly 75 million doses of its COVID-19 vaccine, EU public data show. The company has two contracts with the 27-nation bloc for up to 460 million shots.

Spanish pharma company Rovi, which bottles Moderna vaccines for markets outside of the United States, said the contamination could be due to a manufacturing issue on a production line. A spokesperson said the company could not say anything more while it was investigating.

Moderna put the lot in question and two adjacent ones on hold.

NHK, in a report published late on Thursday, cited health ministry sources as saying the contaminant was believed to be a particle that reacted to magnets and was therefore suspected to be a metal. Moderna has described it as “particulate matter” that did not pose a safety or efficacy issue.

A Japanese health ministry official said the composition of the contaminant has not been confirmed. In a statement, Takeda said it asked Moderna to investigate the issue and that it would work with the ministry to replace the affected supply.

News of the contaminant could prove a fresh setback for Japan’s inoculation drive as it struggles to persuade many - particularly young people - to get vaccinated.

4 Key Areas to Compare Natural Immunity vs Artificial Immunity

Active Immunity is subdivided into two categories: Natural and Artificial.

Natural Immunity: Immunity developed over time by exposure to infection/virus can be called natural immunity.

Artificial Immunity: The Antibodies generated after vaccination are an artificial method of Immunity generation.

Passive Immunity is also subdivided into two categories: Natural and Artificial.

Natural Immunity: It is acquired naturally such as the fetus gets antibodies from the mother.

Artificial Immunity: It is acquired from serum or plasma, which contains antibodies.

There are marked differences in your immune system after natural infection with coronavirus and after vaccination.  Which is better?

Even asking the question bordered on heresy a year ago, when catching Covid for the first time could be deadly, especially for the elderly or people already in poor health.

Now, we're no longer starting with zero immunity as the overwhelming majority of people have either been vaccinated or have already caught the virus.

It is now a serious question that has implications for whether children should ever be vaccinated. And whether we use the virus or booster shots to top up immunity in adults. Both have become contentious issues.

The anatomy of immunity

We need to understand a little bit about the key building blocks of both our immune system and the virus it is attacking.

The power-couple of the immune system that clears the body of infection are antibodies and T-cells. Antibodies stick to the surface of the virus and mark it for destruction. T-cells can spot which of our own cells have been hijacked by the virus and destroy them.

For all the trouble the virus has caused, it is spectacularly simple. It has the famous spike protein, which is the key it uses to unlock the doorway into our body's cells. And 28 other proteins that it needs to hijack our cells and make thousands of copies of itself. (For comparison it takes about 20,000 proteins to run the human body).

There are four key areas to compare vaccine and natural infection with the virus.

#1 Breadth

How much of the virus the immune system learns to attack

You get a broader immune response after being infected with the virus than vaccination.

Whether you've had Moderna or Pfizer or Oxford-AstraZeneca, your body is learning to spot just one thing - the spike protein.

This is the critical part of the virus to make antibodies to, and the results - by keeping most out of hospital - have been spectacular.

But having the other 28 proteins to target too, would give T-cells far more to go at.

"That means if you had a real humdinger of an infection, you may have better immunity to any new variants that pop up as you have immunity to more than just spike," said Prof Riley.

#2 Strength

How well it stops infection or prevents severe disease

We know there have been cases of people catching the virus twice (re-infection) and of being vaccinated and catching Covid (known as breakthrough infection).

"Neither gives you complete protection versus infection, but the immunity you get from either seems to protect you pretty well from serious illness," said Prof Finn, from the University of Bristol.

Antibody levels are, on average, higher about a month after vaccination than infection. However, there is a huge gulf in antibodies between those who are asymptomatic (who don't make very much) and those who get a severe bout of Covid.

The biggest immune response comes from people who caught Covid and were then vaccinated.

We're still waiting for data on people that caught Covid and were unvaccinated.

#3 Duration

How long does protection last?

Antibody levels have been shown to decline over time, although this may not be important for preventing severe disease.

The immune system remembers viruses and vaccines so it can respond rapidly when an infection is encountered.

There are "memory T-cells" that linger in the body, and B-cells remain primed to produce a new flood of antibodies on demand. There is evidence of immune responses more than a year after infection and vaccine trials have also shown lasting benefit.

"In terms of durability, we're still waiting to see," said Prof Peter Openshaw, from Imperial College London.

#4 Location

Where in the body is the immunity?

This matters. There is a whole different suite of antibodies (known as immunoglobulin As) in the nose and lungs, compared with those (immunoglobulin Gs) that we measure in the blood.

The former is more important as a barrier to infection. Natural infection, because it is in the nose rather than a jab in the arm, maybe a better route to those antibodies, and nasal vaccines are being investigated too.

Prof Paul Klenerman, who researches T-cells at the University of Oxford, said: "The location of an infection makes a difference even if it's the same virus, so we would expect important differences between natural infection and vaccines."

Where does this leave the balance between more vaccines and viruses?

There is clear evidence that adults who have not had any vaccine dose will have stronger immune defenses if they do get vaccinated, even if they have caught Covid before.

But there are three big questions:

#1 Do vaccinated adults need to be boosted or is exposure to the virus enough?

#2 Do children need vaccinating at all, or does a lifetime of encountering build a good immune defense?

#3 Do we understand the injuries people are getting from the vaccines enough to weigh the risks. 

The idea of regularly topping up immunity throughout life is not radical in other infections, such as RSV (respiratory syncytial virus) or the four other coronaviruses that infect people and cause common cold symptoms.

Each time you're exposed, the immune system gets a little bit stronger, and this continues until old age, when the immune system starts to fail and the infections become a problem again.

"This isn't proven, but it could be a lot cheaper and simpler to let that happen than spend the whole time immunizing people," said Prof Finn, who warns we could end up "locked into a cycle of boosting" without seeing if it was necessary.

However, he said the argument in children had "already been won" as "40-50% have already been infected and most weren't ill or particularly ill".

There are counter-arguments. Prof Riley points to long-Covid in children, and Prof Openshaw to nervousness around the long-term effects of a virus that can affect many of the body's organs.

YouTube Has Censored 1 Million Videos For Having Opposing Views

YouTube has removed 1 million videos for dangerous COVID-19 misinformation (aka opposing views) since February 2020, according to YouTube’s Chief Product Officer Neal Mahon.

Mahon shared the statistic in a blog post outlining how the company approaches misinformation on its platform. “Misinformation has moved from the marginal to the mainstream,” he wrote. “No longer contained to the sealed-off worlds of Holocaust deniers or 9-11 truthers, it now stretches into every facet of society, sometimes tearing through communities with blistering speed.”

At the same time, the Youtube executive argued that “bad content” accounts for only a small percentage of YouTube content overall. “Bad content represents only a tiny percentage of the billions of videos on YouTube (about .16-.18% of total views turn out to be content that violates our policies),” Mahon wrote. He added that YouTube removes almost 10 million videos each quarter, “the majority of which don’t even reach 10 views.”

Facebook recently made a similar argument about content on its platform. The social network published a report last week that claimed that the most popular posts are memes and other non-political content. And, faced with criticism over its handling of COVID-19 and vaccine misinformation, the company has argued that vaccine misinformation isn’t representative of the kind of content most users see.

Both Facebook and YouTube have come under particular scrutiny for their policies around health misinformation during the pandemic. Both platforms have well over a billion users, which means that even a small fraction of content can have a far-reaching impact. And both platforms have so far declined to disclose details about how vaccine and health misinformation spreads or how many users are encountering it. Mahon also said that removing misinformation is only one aspect of the company’s approach. YouTube is also working on “ratcheting up information from trusted sources and reducing the spread of videos with harmful misinformation.”

The US Equal Employment Opportunity Cmmission announced that employers could require workers to be vaccinated against COVID-19 as long as they did not violate the Americans with Disabilities and the Civil Rights acts. The federal guidance prompted a number of states to prohibit businesses from requiring COVID-19 vaccinations as a condition of work. However, some states have sought to require COVID-19 vaccines for state employees and health workers. Alabama On May 17, Gov. Kay Ivey signed SB 267, which prohibits a state or local government entity, or any of its officers or agents, from issuing vaccine or immunization passports, vaccine or immunization passes, or any other standardized documentation for the purpose of certifying the immunization status of an individual.

Alaska On April 26, Gov. Mike Dunleavy issued an order prohibiting Executive Branch departments, agencies, officials, state entities, and the public from requiring any person to produce their personal vaccine history in order to travel to or around Alaska.

Arizona On April 19, Gov. Doug Ducey issued an order prohibiting all state and local governments from requiring people to prove their COVID-19 vaccination status to enter a business, building or area or to receive government service, permit or license. Private businesses and healthcare institutions, however, can still require COVID-19 vaccination status documentation of patients, residents, employees or visitors.

On June 30, the governor signed SB 1824, which prohibits the establishment of a COVID-19 passport.

Arkansas On April 30, the state enacted SB 615, which prohibits the use of a vaccine passport for any purpose including as a condition for entry, travel, education, or services.

California On June 18, the California Department of Public Health and Technology launched the Digital COVID-19 Vaccine Record portal, a website that allows residents to upload a digital copy of their vaccination record.

Colorado There is no requirement or ban in place in this state.

Connecticut There is no requirement or ban in place in this state.

Delaware There is no requirement or ban in place in this state.

District of Columbia There is no requirement or ban in place in this state.

Florida On April 2, Gov. Ron Desantis announced that no Florida government entity, or its subdivisions, agents, or assigns, can issue vaccine passports, vaccine passes, or other standardized documentation for the purpose of certifying an individual's COVID-19 vaccination status to a third party, or otherwise publish or share any individual's COVID-19 vaccination record or similar health information; and that businesses in Florida are prohibited from requiring patrons or customers to provide any documentation certifying COVID-19 vaccination or post-transmission recovery to gain access to, entry upon, or service from the business.

On May 3, the governor signed SB 2006, which prohibits COVID-19 vaccine passports and codifies the governors aforementioned order.

Georgia On May 25, Gov. Brian Kemp announced that no state agency, provider of state services, or state property can implement a Vaccine Passport Program.

Hawaii On May 11, the state launched its inter-island vaccine passport program that exempts vaccinated travelers from needing to get tested or quarantine prior to traveling between islands.

Idaho On April 7, Gov. Brad Little issued an order prohibiting any state department, agency, board, commission, or other executive branch entity or official from requiring proof of COVID-19 vaccination from individuals as a condition of accessing state services or facilities, producing or issuing a passport to certify an individual has been vaccinated, or providing information of an individual’s vaccine status to any entity as part of a passport program

Illinois There is no requirement or ban in place in this state.

Indiana On April 29, Gov. Eric Holcomb signed HB 1405, which prohibits the state or a local unit of government from issuing or requiring immunization passports.

Iowa On May 20, Gov. Kim Reynolds signed HF 889, which prevents state and local governments from including a person’s vaccination status on a government-issued identification card. The bill also withholds state grants and contracts from local governments or businesses that require customers to prove they have received the COVID-19 vaccine.

Kansas On May 26, Gov. Laura Kelly signed SB 159, which prohibits state agencies from issuing a COVID-19 vaccination passport to any individual without such individual's consent or requiring an individual to use a COVID-19 vaccination passport within the state for any purpose.

Kentucky There is no requirement or ban in place in this state.

Louisiana Vaccine passports are not required or banned in this state. On July 20, Gov. John Bel Edwards vetoed a bill that would have prohibited requirements such as having proof of vaccination on driver's licenses.

Missouri On June 15, Gov. Michael Parson signed SB 271, which prohibits any county, city, town, or village receiving public funds from requiring documentation of an individual having received a vaccination against COVID-19 in order for the individual to access transportation system or services or any other public accommodations.

Montana On April 13, Gov. Greg Gianforte issued an executive order prohibiting the state-sponsored development and required use of vaccine passports to access state services or facilities. The order also prohibits businesses from requiring customers to provide proof of vaccination to enter or receive services from a business.

On May 7, the governor signed HB 702, which prohibits discrimination based on vaccination status or whether the person has an immunity passport.

Nebraska There is no requirement or ban in place in this state.

Nevada There is no requirement or ban in place in this state.

New Hampshire On July 26, Gov. Chris Sununu signed HB 220, which prohibits any government agency or political subdivision from compelling an individual to provide proof of vaccination to secure, receive, or access any public facility, any public benefit, or any public service from the state.

New Jersey There is no requirement or ban in place in this state.

New Mexico There is no requirement or ban in place in this state.

New York On March 26, Gov. Andrew Cuomo announced the launch of Excelsior Pass, a voluntary app that allows people to upload negative COVID-19 test results or proof of vaccination. People can use the app to access sections reserved for fully vaccinated individuals at participating theaters, major stadiums and arenas, wedding receptions, catered events, and other events.

North Carolina There is no requirement or ban in place in this state.

North Dakota On May 7, Gov. Doug Burgum signed HB 1465, which prohibits a state government entity or any of its subdivisions, agents, or assigns from requiring documentation, whether physical or electronic, for the purpose of certifying or otherwise communicating an individual's vaccination status; the presence of pathogens, antigens, or antibodies; or an individual's post-transmission recovery status before providing access to state property, funds, or services.

On April 8, the legislature passed SCR 4016, which encourages Congress to refrain from issuing a vaccine passport and from enacting any law that would restrict an individual's right to travel or participate in commerce, religious freedom, and education based on whether the individual has received a COVID-19 vaccine.

Ohio There is no requirement or ban in place in this state.

Oklahoma May 28, Gov. Kevin Stitt signed SB 658, which prohibits a board of education of a public school district or a technology center school district, the board of regents of an institution within The Oklahoma State System of Higher Education, the governing board of a private postsecondary educational institution, the Oklahoma State Regents for Higher Education, the State Board of Education or the State Board of Career and Technology Education from requiring a vaccine passport as a condition of admittance to or attendance of the school or institution.

On May 28, the governor issued an order prohibiting state agencies from requiring that people show proof of vaccination to enter public buildings. The order doesn't apply to employees or buildings of state agencies that are primarily involved in medical patient-facing activities.

South Carolina On May 11, Gov. Henry McMaster issued an order prohibiting state and local government agencies from requiring proof of vaccination or vaccine passports to receive government services or gain access to ant building, facility, or location.

South Dakota On April 21, Gov. Kristi Noem issued an order prohibiting state and local agencies from developing vaccine passports or requiring that people show proof of vaccination.

Tennessee On May 26, Go. Bill Lee signed SB 858, which prohibits any state or local governmental official, entity, department, or agency from requiring physical documentation or digital storage of protected health information related to an individual's immunization or vaccination against COVID-19 as a condition of entering upon the premises of a state or local government entity, or utilizing services provided by a state or local government entity.

Texas On April 6, Gov. Greg Abbott issued an order prohibiting state agencies or political subdivisions from creating a vaccine passport requirement, or otherwise conditioning receipt of services on an individual’s COVID-19 vaccination status. The order also prohibits organizations receiving public funds from requiring consumers to provide documentation of vaccine status in order to receive any service or enter any place.

On June 16, the governor signed SB 968, which prohibits governmental entities from issuing any standardized documentation to certify COVID-19 vaccination for a purpose other than health care.

On July 29, the governor issued an order reiterating the ban on vaccine passports passed by the legislature.

Utah On March 16, Gov. Spencer Cox signed House Bill 308, which prohibits state agencies and public universities from requiring people to show proof of vaccination.

This article tracks state government legislation and executive orders related to COVID-19 proof-of-vaccination requirements. Proof-of-vaccination requirements are business or government requirements that people prove they have been vaccinated against COVID-19. State governments have enacted various rules around the use of proof-of-vaccination requirements in their states, such as banning proof-of-vaccination requirements in some circumstances or implementing policies—sometimes called vaccine passports—that allow vaccinated people to bypass COVID-19 restrictions or engage in activities unavailable to unvaccinated people.

20 states, all with Republican governors, prohibit proof-of-vaccination requirements. In eleven states, governors banned proof-of-vaccination requirements through executive orders. In nine states, legislators passed laws banning proof-of-vaccination requirements.

4 states—California, New York, Hawaii, and Oregon—have facilitated the creation of digital vaccination status applications or exempt fully vaccinated individuals from some COVID-19 restrictions if they can provide proof of vaccination. All four states have Democratic governors.

Twenty states have banned proof-of-vaccination requirements. All 20 states—Alabama, Alaska, Arizona, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Missouri, Montana, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, and Wyoming—have Republican governors. In total, 20 out of the 27 states with Republican governors have prohibited proof-of-vaccination requirements through executive orders or legislation. Eight states with Republican governors—Maryland, Massachusetts, Mississippi, Nebraska, New Hampshire, Vermont, West Virginia—have not prohibited proof-of-vaccination requirements at any level of government.

Four states have facilitated the creation of digital vaccination status applications or proof-of-vaccination programs that allow fully vaccinated people to bypass some coronavirus restrictions. All four states—California, Hawaii, New York, and Oregon—have Democratic governors. Nineteen states with Democratic governors have neither prohibited nor facilitated proof-of-vaccination requirements at any level of government.
