Numerous groups of engaged citizens have been spontaneously forming throughout California to defeat the COVID-19 vaccine mandate for all K-12 students, but most of these groups have remained fragmented and are failing to leverage the power of large numbers working together through statewide unity.  

We are a group of concerned families, business leaders, and other professionals that recently joined together to launch The Unity Project to aid a unified movement against forced Covid-19 child vaccines, via unification efforts, resourcing, and the need to amplify the best strategies of the most effective groups already doing tremendous work in this space.

We recognized the urgent need to unite statewide into a powerful force of concerned citizens that is well-resourced, well-coordinated with streamlined communication and propelled by strong execution across the state. Our humble intention is to also serve as a catalyst that significantly amplifies the best strategies being driven by the most experienced and effective groups in the space.

The effort has been met with overwhelming enthusiasm, as everyone knows there’s tremendous power in large numbers acting together.

Forcing children as young as five years old to effectively become human shields, assuming vaccine-injury-risk despite having statistically zero risk of COVID-19 to those who are healthy, just so adults with comorbidities can feel safer — what kind of a society does that?  At no time in history have we put children in harm’s way to protect adults.

Stripping risk/benefit discretion from parents with a novel vaccine for children, which, if healthy, are at statistically greater risk of the seasonal flu than Covid-19.

Illogical, unscientific, top-down, one-size-fits-all carte blanche mandates for healthy children that directly contradict the current body of evidence and data.

This blatant move toward an ever-increasing surveillance state is being welcomed by many who have been led to believe they’re necessary to protect public health and safety.

In the U.S., universities continue to institute lockdowns for students, going so far as to ban even outdoor exercise.

While many countries have suggested that the COVID-19 vaccine will not be mandated, by giving special privileges to the vaccinated, such as the ability to travel, attend social events or even enter a workplace, it essentially amounts to the same thing and insinuates a “cleaner” class of people in those who have been vaccinated.

For a weary public longing to get back to normalcy, vaccine passports represent a tantalizing carrot, being dangled as a mechanism for freedom. By showing proof that you’ve received a COVID-19 vaccine, perhaps you can once again board an airplane and travel freely, attend a concert or enjoy a meal in your favorite restaurant, just like you used to.

Except, being required to present your “papers” in order to live your life isn’t actually freedom at all — it’s discrimination, and even a move toward technocratic fascism, one that’s setting the stage for increased surveillance and erosion of your privacy.

Nonetheless, this blatant move toward an ever-increasing surveillance state is being welcomed by many who have been led to believe the passports are necessary to protect public health and safety.

Vaccine passports are in development

It’s likely only a matter of time before you’ll be asked to prove your vaccination status in order to carry on with your daily life. “The government seems to be developing vaccine passports by stealth, making sure the technology is in place for anyone who needs it,” wrote Lara Prendergast, The Spectator’s assistant editor.

She’s referring to the U.K. government, which has given sizable grants to a number of private companies developing such technology. This includes more than $86,000 to Logifect, to create and launch a vaccine passport app, and more than $104,000 to iProov and Mvine, which are developing digital certificates that show vaccination status.

As Prendergast noted, “Your phone would most likely be your vaccination passport. Everyone’s vaccination status is already being logged centrally by the National Immunization Vaccination System using their NHS number. This information could be easily linked with an app.”

Around the world, vaccine passports are rapidly being rolled out, including in Denmark, which was one of the first to roll them out. As of September 2021, dozens of countries around the world have implemented vaccine passports, while in the U.S., plans for vaccine IDs are under evaluation. International efforts are also underway.

The Commons Project and the World Economic Forum created the Common Trust Network, which developed the CommonPass app that’s intended to act as a health passport.

The app allows users to upload medical data such as a COVID-19 test result or proof of vaccination, which then generates a QR code that you will show to authorities as your health passport.

The proposed common framework “for safe border reopening” around the world involves the following:

Every nation must publish their health screening criteria for entry into the country using a standard format on a common framework.

Each country must register trusted facilities that conduct COVID-19 lab testing for foreign travel and administer vaccines listed in the CommonPass registry.

Each country will accept health screening status from foreign visitors through apps and services built on the CommonPass framework.

Patient identification is to be collected at the time of sample collection and/or vaccination using an international standard.

The CommonPass framework will be integrated into flight and hotel reservation check-in processes.

Eventually, the CommonPass framework will be integrated with already existing personal health apps such as Apple Health and CommonHealth. If you want to travel, your personal health record will be evaluated and compared to a country’s entry requirements, and if you don’t meet them, you’ll be directed to an approved testing and vaccination location.

Majority are in favor of ‘privacy-encroaching technology’

Even as overall mortality data separating deaths “from” COVID and “with” COVID show COVID-19 is hardly the deadly pandemic it’s been made out to be, fear-mongering remains in full effect — including warnings on the more infectious, mutated strain of SARS-CoV-2, Delta.

With fear still omnipresent, acceptance of “privacy-encroaching technology” that promises an illusion of safety is high.

In the U.K., researchers from the University of Bristol conducted two large surveys about such technologies, with overwhelming positivity reported. The first measured public acceptance of location tracking through your cellphone that would allow health agencies to monitor your contact with others to target social distancing and quarantine measures.

About 70% of the respondents said they would accept such an app that they could choose to download and, surprisingly, 65% also said they would accept such an app even if it was mandated by the government and used to locate those violating lockdown orders and issue fines and arrests.

A second survey evaluated acceptance of vaccine passports, with 60% stating they were in favor and only 20% stating they were strongly opposed. The study’s lead author, professor Stephan Lewandowsky, described those opposed as “surprisingly low,” adding, “It’s fascinating how people seem increasingly receptive to their personal data being used to inform themselves and others about what they can and can’t do.”

Prendergast put this widespread acceptance into further context for the British, who “have traditionally been deeply suspicious of the idea of an official asking for ‘papers, please‘”:

“[This] … is why there was such a backlash against Blair’s ID cards. As one journalist at the time put it:

“’If I am ever asked to produce my ID card as evidence that I am who I say I am, when I have done nothing wrong and when I am simply ambling along and breathing God’s fresh air like any other freeborn Englishman, then I will take that card out of my wallet and physically eat it in the presence of whatever emanation of the state has demanded that I produce it.’

“That journalist is now our Prime Minister. It would be an extraordinary turn of events if Boris Johnson ended up being the man who introduced an immunity identity system in Britain.”

U.S. universities institute jail-like restrictions

At every turn, long-standing societal norms — like college students gathering with friends in their dorm or even leaving their rooms for work and exercise — are disappearing. As of Feb. 7, for instance, the University of Massachusetts Amherst was in a “high risk” operational mode due to a “continuing surge in COVID-19 cases.”

The status, which was to be in place for a minimum of 14 days, made all classes remote and ordered all students, whether residing on or off campus, to self-sequester in their residences, except to get meals, attend medical appointments or undergo twice-weekly COVID testing.

Violating these orders would result in “disciplinary action,” according to a university press release, which could include removal from residence halls or suspension. Students were also informed that, should they decide to leave campus to self-sequester at home, “it is highly unlikely we will be able to accommodate your return.”

Even within a residence hall, students were told to remain in their rooms at all times except when using a restroom on their floor. Outdoor exercise or attending to the immediate needs of a pet was allowed, but only when wearing a mask and maintaining social distancing.

This wasn’t the case at UC Berkeley, however, which banned outdoor exercise in addition to extending dormitory lockdowns in February 2021. The only times students were allowed to leave their rooms during the lockdown were to obtain medical care, get required COVID tests, use an assigned bathroom or to obtain food from an outdoor dining kiosk, after which they were required to return immediately to their rooms.

Are you clean enough to travel?

While many countries have suggested that the COVID-19 vaccine will not be mandated, by giving special privileges to the vaccinated, such as the ability to travel, attend social events or even enter a workplace, it essentially amounts to the same thing and insinuates a “cleaner” class of people in those who have been vaccinated.

It’s reminiscent of the early days of the pandemic, when hand sanitizer and disinfectant wipes were flying off store shelves in a frenzy to clean away COVID. Now we know that transmission of COVID-19 by fomites — the term used for inanimate surfaces and objects that can transmit a pathogen — has been exaggerated.

Emanuel Goldman, a microbiology professor at Rutgers New Jersey Medical School, suggested this in July 2020, when he stated that studies suggesting SARS-CoV-2 was easily spread via surfaces did not present real-life situation.

“In my opinion, the chance of transmission through inanimate surfaces is very small,” he said, and while period disinfection of surfaces, especially in hospitals, was a reasonable precaution, in public settings, he noted, “this can go to extremes not justified by the data.”

In February 2021, an editorial in Nature supported Goldman’s work, suggesting that costly and toxic disinfection efforts are misguided.

“Catching the coronavirus from surfaces is rare. The World Health Organization and national public health agencies need to clarify their advice,” the editorial reads. Yet, the New York City Metropolitan Transit Authority alone is spending an estimated $380 million annually on COVID-related sanitation, and when it asked the U.S. government whether they should be focusing on fomites or solely aerosols, they were told to continue their focus on fomites.

Writing in The Atlantic, Derek Thompson describes this as a type of “hygiene theater,” in which Americans are going through the motions of dutifully cleaning and, likely, over-disinfecting surfaces when the virus spreads most efficiently through the air.

Indeed, much of the COVID-19 pandemic response has been embroiled in theatrics, including mask mandates, for which the scientific evidence has been described as “astonishingly weak.”

Hygiene theater, much like the theater for vaccine passports, provides an illusion of safety, not one grounded in reality.

Polls Show Gavin Newsom Losing Recall Election by Over 10%+

Just prior to the start of the first televised debate in the Gavin Newsom recall election Wednesday evening, a shock poll showed the governor losing the first question ("Should Gavin Newsom be recalled?") by double digits.

The poll came from Survey USA and the San Diego Union Tribune, and was conducted among 1,100 Californians from Aug. 2 to Aug. 4. It found that 51% of respondents were in favor of recalling Newsom, while only 40% wanted to keep him in power. The previous Survey USA/San Diego Union-Tribune poll from May found 36% in favor of the recall with 47% opposed.

Unlike a recent UC Berkeley/Los Angeles Time poll that was weighted by whether the respondent was likely to vote in the Sept. 14 recall election, the Survey USA carried no such weight, which is even more alarming for the governor. The Berkeley/Los Angeles Time poll found double-digit opposition to the recall, but a dead heat when weighted by likelihood to vote. Polls have consistently shown a large enthusiasm gap, strongly suggesting Republicans are more likely to turn out.

The new poll's other shocking finding is a new leader on question two ("Which candidate should replace Newsom if he loses question one"): YouTuber Kevin Paffrath, the most high-profile Democrat on the bottom of the ballot.

Paffrath received 27% support, with conservative radio host Larry Elder, who led three separate polls released in recent weeks, at 23% support. The only other candidate with double-digit support was businessman John Cox (10%).

Former San Diego Mayor Kevin Faulconer came in fourth with 5% support, while reality TV star Caitlyn Jenner and former Rep. Doug Ose tied for fifth, with 4% support.

Every year, tens of thousands of Americans get sick from diseases that could be prevented by vaccines – some people are hospitalized, some even die. Immunization is our best protection against these diseases.

NFL wide receiver for the Buffalo Bills, Cole Beasley spoke to the media about his stance on the COIVD 19 and his interactions on social media.  Cole Beasley is concerned for the younger NFL players who feel pressure to take the vaccine for fear of being cut if they refuse to take it.   

I support Cole Beasley's choice 110 percent. It is extremely wrong and inhumane to force players to either take an experimental drug or be cut. By doing this, the league is indirectly making the vaccine mandatory by putting measures in place to force individuals to take it.

Constant bombardment with this question!  Workplaces asking if you are vaccinated.  Thankfully most workplaces are giving you the option to not disclose in the U.S..  

Co-worker: "Have you been vaccinated?"

My best friend: "Have you been vaccinated?"

Clients: "Have you been vaccinated?"

Neighbors: "Have you been vaccinated?"

My sister: "Have you been vaccinated?"

Random person on the street (I shit you not): "Have you been vaccinated?"

None of your business! I don't go around asking people to reveal their medical history to random strangers. What the hell happened to the concept of personal integrity?

I really think this is one of the greatest losses that the "pandemic" has provided. People feel entitled to intrude on others' medical history and personal life in general. And they're encouraged to do so both by the state and the media.

It's sick. It's genuinely sick.

I am going to start asking people if they have any STDs when they ask me if I am vaxxed.

Ask them if (female) they have ever had an abortion (male) or paid for abortion it starts getting real uncomfortable.

I’m losing hope. Every single person around me is caving to the pressure. Why can’t they see that we are already living in tyranny? They “are tired of stressing about it.” They are afraid of losing rights so they just do it. That’s insane. I’m very sad about this.

People are so desperate to return to normality that they are willing to jump through any hoop. They don’t realize that this was called the new normal for a reason and they can’t escape it by doing as they are told.

Why not just ignore everyone and move on with our lives. If covid gets worse and non vaxx get hurt we’ll deal with it. If covid gets worse and vaxx doesn’t help against new strain? We’ll deal with it.

Legally, a vaccinated person is not required to share that information with everyone who asks, says Jennifer Piatt, an attorney and research scholar at the Center for Public Health Law and Policy Health. "Information may be deeply personal for some people, and they may choose not to share that information openly." 

 There is no legal requirement that individuals must disclose their vaccination status publicly, Piatt says, or to all interested persons. "An individual can set [their] own boundaries with respect to what information they are comfortable sharing with others." That said, says Piatt, vaccination information may be required in certain situations. 

For example, schools require information about childhood vaccinations for public safety purposes. In addition, employers generally may be able to ask about vaccine status for safety and planning purposes, barring contrary state or local laws.

California looks like they are slipping down a slope of unethical mandates.

Bill & Melinda Gates Foundation funded an MIT "quantum dots" project to track vaccines and could be delivered to the skin to record vaccinations. 

Conspiracy theories need just the right ingredients to take off within a population, and the COVID-19 pandemic has been a breeding ground for them. A Pew Research Center survey recently asked people if they had heard the theory that the COVID-19 outbreak was intentionally planned by people in power. Seventy-one percent of U.S. adults said they had. And a third of those respondents said it was "definitely" or "probably" true.

One version of this theory goes something like this: The COVID-19 pandemic is part of a strategy conceived by global elites — such as Bill Gates — to roll-out vaccinations with tracking chips that would later be activated by 5G, the technology used by cellular networks.

Residents of Palm Beach County, Fla., cited it in a county commissioner's hearing in late June when voicing their opposition to mandatory mask enforcement. "Six feet ... is military protocol. You're trying to get people to train them, so when the cameras, the 5G comes out, what? They are going to scan everybody? We've got to get scanned? We've got to get temperature? ... Are you insane?" asked Cristina Gomez, one of the residents who attended the hearing. She even mentioned Gates by name, asking the commissioners why he is not in jail.

Molly, 24, who lives in Kentucky and asked that her last name not be used, said earlier this spring, her sister told her she did not intend to get the COVID-19 vaccine because she believed it contained microchips. Molly said she was shocked.

"I was like, what are you talking about? That's not true. And she's like, 'Oh well, you know so much about science.' I'm like, I know that there's no microchips in vaccines." She said the conversation spiraled into a fight. "Then I just went upstairs and cried because we are best friends. And now since this, we basically haven't talked about COVID or what's going on at all."

Otis Hart, 42, in New York City sought the help of a tinnitus therapist in May following an ear injury. At the end of his session, Hart shared that he was looking into getting a better Internet connection. "[My therapist] said that things like 5G [are] responsible for some terrible things going on," Hart said. "And he connected 5G with the coronavirus pandemic." Hart said he stopped seeing him after this appointment.

NPR talked to more than a dozen people who said they had similar experiences. So how did this particular theory come to be?

The first ingredient of a good conspiracy is a plausible element. Not one that's necessarily true, just plausible. In this case, the tracking chips. In December, a team of Massachusetts Institute of Technology researchers published a paper in the medical journal Science Translational Medicine detailing how something called "quantum dots" could be delivered to the skin to record vaccinations.

Kevin McHugh, now an assistant professor of bioengineering at Rice University and the lead researcher on the project, said he's baffled by the idea that his project involves tracking chips. "There's no microchips at all," he said. "I don't even know where that comes from. All the quantum dots [do is] produce light."

The technology, tested on rats, has not yet been tested on humans. McHugh said the dot signals a patient has received a vaccine in an effort to keep an accurate record.

"It is really difficult to determine who has received what vaccines in the developing world because there is not good record-keeping," McHugh said. "So the idea is, can we actually have something that could inform a health care worker what vaccines have been administered and therefore which ones are still needed?"

Funding for the project was provided by the Bill & Melinda Gates Foundation, which brings us to the second ingredient of a good conspiracy theory: a real person, someone powerful — and rich.

Kate Starbird, an associate professor at the University of Washington, who has studied misinformation during crisis events, said conspiracy theories use the same elements and plug in different actors.

"A rich person controls the world and they want to do bad things so they can continue controlling the world," she said. "Sometimes it's George Soros. Now it's Bill Gates. So, they just move that person over."

But why Gates this time?

Steven Brill is the founder of NewsGuard, a company that tracks false information. He said there are two reasons: The Gates Foundation funds global vaccination research and drives, and Gates is the co-founder of Microsoft Corp.

"So you have the anti-vaxxer movement targeting Bill Gates as well as the anti-tech movement," Brill said.

The anti-tech movement brings us to the final ingredient of a good conspiracy theory: an element that makes it go viral. In this case, the fear of 5G and the power of social media.

Joseph Downing, a fellow at the London School of Economics, studied the origins of the 5G conspiracy theory on social media and said he and his colleagues were able to track down the exact account that turned this conspiracy theory into a trending topic on Twitter.

The account was @5gcoronavirus19, which sent out 303 tweets in seven days.

"So you've got somebody here who understands a way of, in effect, kind of manipulating the social media landscape," Downing said.

It's unclear who operated the @5gcoronavirus19 account, which has since been taken down. But it managed to create such momentum that other platforms picked it up from there. Downing said someone doesn't need to have a huge following to do that; they just need to know how the algorithm works.

"One thing that we found that was really important was that people were tagging President Trump in their tweets. And that was enough to gain traction," he said.

Enough traction that more than 70 cellphone towers were set on fire in the United Kingdom in April and May because of their alleged link to the spread of the virus, Mobile UK, which represents Britain's four mobile operators, told Business Insider in May.

"In the [time of] COVID-19, when we can see [that] a large number of people begin to believe these things and take actions that are harmful to either themselves or their communities — then those theories are translated into harm," Starbird said.

And experts such as Brill and Downing agree: A society so divided because of misinformation can lead to disruptions in elections, health care and even create distrust in the entire democratic system.

President Joe Biden wants to suppress speech that discourages Americans from being vaccinated against COVID-19. Because the First Amendment doesn’t allow him to do that, he is asking Facebook and other social-media giants to do it for him.

Vaccine skepticism has existed since the advent of the technology itself. However, the mass uptake of social media is blamed for the significant traction recently gained by the ‘anti-vax’ movement. A recent report found that 400 anti-vax social media accounts contain 58 million followers based primarily in the US, UK, Canada and Australia.

Government-based censorship laws & big tech censorship policies should not be implemented for three main reasons.

#1 - Many people have legitimate concerns around the safety and efficacy of COVID-19 vaccines due to factors including the speed of their development, the underrepresentation of ethnic minority groups in clinical trials and the unknown longevity of their immunological effects. The public must feel freely able to voice these concerns, raise challenging questions and expect transparent replies from trusted institutions. An unintended effect of shutting down anti-vax groups may be to silence those with legitimate questions for fear of shame or ridicule and lead them to harbor greater suspicion of public health authorities and sympathize with anti-vax rhetoric.

#2 - Emergency laws would enforce censorship and de-platforming and threaten the democratic cornerstone of freedom of speech. All ideas – even the bad ones – must be allowed a public airing, and their qualities debated in the marketplace of ideas. It is through this process that institutions foster influence, respect, and public trust, by presenting empirical evidence, reasoned arguments, and a scientific method based on critical thinking. Conversely, widespread de-platforming of anti-vax campaigners is unlikely to dissuade those sympathetic to these messages but rather reinforce their strongly held beliefs about vaccine conspiracies while deepening their mistrust of public health authorities. In addition, removing the social media stages of anti-vax campaigners is likely to drive them underground to adopt alternative stages that are more difficult to identify, monitor, and respond to with public health messaging. The lack of evidence to support censorship as a reliable means of producing desirable health behavior change should deter against the deployment of this strategy.

#3 - The features of an ‘anti-vax campaign’ are themselves undetermined and, depending on the breadth of the definition imposed, may include both the mere voicing of concern for vaccine safety and the intentional distribution of dangerous falsities. Governments will be without the substantial resources required to identify all online anti-vax campaigns and thus will be forced to hand over decision-making powers to social media platforms themselves. This is unlikely to be an optimal strategy for the delivery of public health messaging and risks triggering dangerous normative shifts in the ability of social media platforms to control what the public is and is not able to see.

In any event, all Americans should be alarmed that these giant firms are acting as judge and jury on enormously important issues, like our health or our elections. They must not be allowed to control our information, nor our country. Today, they are doing both.

Court Declares Gov. Newsom’s Abuse of Power Unconstitutional

As the California Globe has reported for several months, California Assemblymen Kevin Kiley and James Gallagher sued to stop the "one-man rule" of California Governor Gavin Newsom. On October 21st, they were in Sutter County Superior Court, alleging that Gov. Gavin Newsom abused his emergency powers in issuing Executive Orders that had nothing to do with the pandemic coronavirus crisis. 

On Monday, in their abuse of power case against Governor Newsom, State Supreme Court Judge Sarah Heckman tentatively ruled in favor of Gallagher (R-Yuba City) and Kiley (R-Rocklin). 

Judge Heckman ruled unconstitutional the Governor's latest Executive Order N-67-20 in the preliminary decision. More significantly, the preliminary decision of Judge Heckman puts a permanent injunction on the Governor that prohibits him from making or modifying state law unilaterally.

Assemblyman Kiley wrote:

The Judge ruled Newsom violated the Constitution. She also issued an injunction restraining the Governor from issuing any more unconstitutional orders. You can read the ruling here.

This marks an end to Gavin Newsom’s one-man rule. It makes clear that the laws of the State of California do not countenance an autocracy under any circumstances – not for a single day, and certainly not for eight months with no end in sight.

The ruling is “tentative,” meaning Newsom has a few days to try to persuade the Judge to change her mind, but it’s rare for a tentative ruling to change. While Newsom can appeal, we are confident the decision is on solid legal ground and will stand.

Kiley and Gallagher claim that the Constitution of California has an explicit clause of separation-of-powers that Gov. Newsom has violated. "The Governor of California is legally barred from doing the very thing that Gov. Newsom did here: exercising legislative authority," they said. 

The Executive Order of Gov. Newsom to create an all-vote-by-mail-poll suspends and significantly alters the Election Code of California. Gov. Newsom claims that the order "fits well within the limited grant of authority by the Governor under the Emergency Services Act." 

"The lawyers of Gov. Newsom claimed that the governor has the" plenary "authority during a declared State of Emergency and under the California Emergency Services Act (CESA), along with" strong police powers.

In her ruling, Judge Heckman explains: 

The Governor takes the position the California Emergency Services Act’s grant of authority to exercise “all police power vested in the state,” allowing him to “promulgate, issue, and enforce such orders and regulations as he deems necessary” authorizes him to legislate by unilaterally amending existing statutory law. Not only is this an active and ongoing controversy between the parties, but it is a critically important one for the Judicial Branch to resolve.

The Governor has issued three executive orders during the current state of emergency specifically regarding the November 3,2020 general election (Def. Exs. 4 and 5; Pl. Ex. D) and has issued more than 50 different executive orders changing numerous Califomia statutes since the state of emergency was declared. (Pl. Ex. F) Further, despite representations by the Governor’s legal counsel that Executive Order N-67- 20 dated June 3,2020 is “withdrawn,” there is no evidence it has been formally rescinded, and the Executive Order includes provisions controlling the election process for the November 3, 2020 General Election which were not superseded by the subsequently enacted legislation.

Specifically, despite the subsequent legislation, the Executive Order remained in effect requiring all county election officials to use the Secretary of State’s barcode tracking system for all mail ballots and altered the statutorily required outreach in Voter’s Choice Act counties to provide noticed, public meetings allowing for public comment on voting access for California voters with disabilities or limited English proficiency.

Judge Heckman also found “The plain meaning of the CESA does not delegate to the Governor the power to legislate, and therefore does not violate the separation of powers under California Constitution.”

Importantly, Judge Heckman did rule “On the issue of whether Executive Order N.67-20 was authorized by the California Emergency Services Act, the court finds the executive order was NOT authorized by the CESA because it improperly amended existing statutory law, exceeding the governor’s authority and violating the separation of powers.” 

The judge explains:

The CESA allows the Governor, during a state of emergency, to issue orders and regulations and to suspend certain statutes, but the plain and unambiguous language of CESA does not permit the Governor to amend statutes or make new statutes. The Governor does not have the power or authority to assume the Legislature’s role of creating legislative policy and enactments. Because Executive Order N-67-20 amended sections of the Elections Code it exceeds the Governor’s authority under CESA and renders Executive Order N-67-2O invalid.

Kiley and Gallagher claimed that, unless allowed by the Constitution, the governor could not exercise legislative authority, while the governor's lawyers argued, "Making orders is what it says," and that the legislature was responsible for overriding the orders of the governor. 

In court, Gallagher and Kiley argued that there is a very clear difference in the emergency powers of the California Governor when it relates to legislation: he does not enact regulations or new laws, but the emergency powers allow the Governor to override legislation that is a roadblock to decision-making during the emergency. If it is getting in the way of promoting emergency operations, he may suspend any regulatory law.

It appears Judge Heckman agreed with them: 

The Court finds good cause to issue a permanent injunction consistent with the request set forth in paragraph 2l of plaintiffs’ complaint (Def. Ex. l), as follows: 8 Gavin Newsom, in his official capacity as Governor of the State of California is enjoined and prohibited from exercising any power under the California Emergency Services Act (Government Code $ 8550 et seq.) which amends, alters, or changes existing statutory law or makes new statutory law or legislative policy.

“Nobody disputes that there are actions that should be taken to keep people safe during an emergency. But that doesn’t mean that we put our Constitution and free society on hold by centralizing all power in the hands of one man,” Gallagher and Kiley said in a press statement.

The Court’s decision does not impact any of the election protocols for the 2020 election.

Why I Have a Right Not To Wear A Mask


I don’t believe in masks outdoors and I wear one indoors reluctantly or on an airplane.  If you want to wear it fine, but at least - I beg you - take proper hygiene when it comes to wearing them. Many people wear one mask for days, even weeks! They don’t wash them. 

This virus is definitely real though the deadliness is very much overblown, masks should be an individual choice and not a mandate, and our elected officials are relishing this opportunity to become very oppressive.

The deadliness is overblown, but the long term effects are not. Make no mistake, this disease is nothing to laugh at. It's more serious than the 2009 swine flu, which was equally nothing to laugh at- it killed a lot of people, but we didn't shut down society for it, and we shouldn't shut down society for COVID. 

The shutdowns cause far more damage than the virus will. It's tyranny and oppression, plain and simple. People can take care of themselves. Trying to impose centralized control over millions of people goes about as well as historically you'd expect it to.

In the long run, those who wear them for an extended period of time will have even more issues with their health, breathing, and bacteria. Many get acne because of all those toxins created by the limitation of breathing coming outside. 

They look dumb, make breathing hard and your glasses fog up.  I’d be a hypocrite to say “ban masks” when I agree with “everyone has a right to do whatever they want” but my general opinion is - yes I’m against them and if anything id rather have a world with no sight of them.

Democrats in The United States want to hire 100,000 contact tracers with the help of Apple iOS to do contact tracing.   Here is their plan to control your life and restrict your freedoms. 

To manage COVID-19 epidemics going forward, communities in the United States need: (1) ready access to rapid diagnostic tests for all symptomatic cases or those with reasonable suspicion of COVID-19 exposure; (2) widespread serological testing to understand underlying rates of infection and identify those who have developed immunity and could potentially return to work or school without fear of becoming infected; and (3) the ability to trace all contacts of reported cases. In order to trace all contacts, safely isolate the sick, and quarantine those exposed, we estimate that our public health workforce needs to add approximately 100,000 (paid or volunteer) contact tracers to assist with this large-scale effort. This workforce could be strategically deployed to areas of greatest need and managed through state and local public health agencies that are on the front lines of COVID-19 response. To do this, we also estimate that Congress will need to appropriate approximately $3.6 billion in emergency funding to state and territorial health departments.

This plan outlines a vision for how to accomplish this goal, including ways that case identification and contact tracing capabilities can be greatly expanded; actions that the federal, state, and local governments and other organizations must take to stand up these capabilities as quickly as possible; and resources that will be needed to accomplish comprehensive case finding and contact tracing.

A national effort to scale up and expand local, state, and territorial case investigation and management is necessary before US communities can begin to return to “normal.” If we can find nearly every case, and trace the contacts of each case, it will be possible, in time, to relax the bluntest approaches: the extreme social distancing measures, such as stay at home orders, and realize the commensurate social and economic benefits.

This document sets forth a call to action that specifies what is needed to enable the United States to massively scale up its ability to identify COVID-19 cases in every community and trace contacts of every case in support of national recovery from COVID-19. In this document, we aim to aid public health officials and decision-makers at all levels of government—local, state, territorial, tribal, and federal—in expanding the capabilities and capacities necessary to undertake the case-based interventions that will greatly reduce transmission of COVID-19 and enable the country to gradually lift social distancing measures and movement restrictions, even before a vaccine is widely available. 

While technology-heavy methods used by Taiwan, Singapore, and South Korea may be difficult to replicate in the US context because of privacy protections, New Zealand and Iceland’s approach could be achievable with a large enough contact tracing workforce. The United States could possibly roll out a mobile contact tracing application that could capture contacts and record their self-reported symptoms. Following the Iceland and Singapore models, with user permission, an app could also record and store user location for contact tracing and tracking purposes. In addition, a national electronic platform for contact tracing could be developed and potentially synced with existing electronic health records.

In order to relax community mitigation efforts and other measures to reduce COVID-19 transmission, it is essential to rapidly test all symptomatic cases of COVID-19, identify and isolate all positive cases, and conduct contact tracing for all close contacts of each and every case. This level of case-based intervention will help enable a lessening of social distancing measures, but it can be accomplished only by massively scaling up the local and state public health workforce—on the order of 100,000 newly engaged workers—to assist with the enormous and unprecedented task of contact investigation and containment on this scale.

In parallel with helping the United States to shift from population-level interventions to more precise case-based interventions, this initiative could provide an income to many who have lost their earnings as a result of the pandemic. Strategic management, training, and support for this workforce will be necessary, and technology must be explored as a force multiplier. Federal, state, territorial, tribal, and local governments each have a role to play to successfully advance this ambitious expansion of existing local, state, and territorial public health capabilities.

Now is the time for Congress, the administration, and the country to come together to adequately fund and implement contact tracing at this required scale. The goal of adding at least 100,000 new contact tracers in the United States and managing their work, while challenging, is achievable with appropriate financial support and a collective commitment. Read the full document.

Here is a list of California cities and counties that have implemented fines for not wearing a mask or face-covering in public: Governor Gavin Newsom issued a statewide mask mandate requiring pretty much everyone to wear a face-covering when outside your home and near other people.

In most cities, only about 50% of the population is following the rules so it's not exactly clear how the mask mandate is being enforced depends on local jurisdictions. Some cities and counties are depending on people's goodwill, and others are forcing violators to pay up.  Here is a map of states where masks are required outdoors.

  • Beverly Hills: $100 fine for the first offense, $200 for a second, $500 for third and subsequent offenses
  • Calabasas: $100 for the first violation
  • Compton: 1st violation - written warning, second violation - $500, third violation - $750, and fourth violation - $1,000
  • Contra Costa County: $100 fine for an individual's first violation, $200 for second and $500 for third; $250 for a business's first violation, $500 for second and $1,000 for third
  • Costa Mesa: $100 fine
  • Duarte: $100 for first offenses, $200 for second offenses, and $500 for every subsequent violation within a one-year period from the initial offense
  • Fremont: $100 fine
  • Glendale: $400 for the first fine, $1,000 for the second fine and $2,000 for the third
  • Hermosa Beach: Citations will come with fines of $100 for the first violation, $200 for a second violation, and $500 for each subsequent violation of the face mask requirement within a one-year period.
  • Irvine: Penalties up to $500 per day
  • Los Angeles County: $100 for the first offenses and $500 and a 30-day permit suspension for multiple fines. 
  • Monterey: $100, second violation - $200, third violation - $500
  • Manhattan Beach: $100 for the first violation, $200 for the second, and $350 for subsequent violations.  Manhattan Beach also gave out fines for not social distancing
  • Marin County: Fines between $25 and $500 for individuals, and between $250 to $10,000 for businesses
  • Monterey: $100 for first violation
  • Napa County: Fines between $25 and $500 for individuals, and between $250 to $10,000 for businesses
  • Riverside County:  $1000
  • Salinas: $100 for first violation, $500 for second and $1,000 for subsequent
  • San Mateo County: $100 fine for the first violation, $200 for the second and $500 for additional violations within a year; business fines between $250 and $3,000
  • Santa Barabara: Up to $1000
  • Santa Clara County: If you get caught without a face covering it could cost you up to $500. The price goes up for violations by businesses, they face fines up to $5,000.
  • Santa Cruz County: $100 for the first offense, $200 for the second and $500 for a third within a year
  • Santa Monica: $100 fine for an individual's first violation, $250 for second and $500 for third; $500 for a business's first violation, $750 for second and $1,000 for third

  • Ventura County:  Up to $1000

Why Everyone is Becoming an Activist

What is activism in this new politically biased fake news Coronavirus quarantine World? Why is it so important to express your 1st Amendment rights to free speech with your local Government? How can you make a difference by writing letters and engaging with local Facebook groups & local news media? 

There is not a person in this world who cannot admit that the Coronavirus data we have been consuming sucks. Public policy has now been established on this horrendous data and fear has parallelized most economies. You can also thank our fake news media that just regurgitated the propaganda without ever doing any research of due diligence.  

Most people think of activism as participating in a protest. However, I prefer is to be an activist by interpreting the news media and data. Information is power if properly communicated to the right individuals.  

The news media has lost all credibility with most intelligent people these days. However, it still has enormous power to influence behavior & Government decisions no matter how misinformed or misguided. I am not sure if I am angrier at the news media or Government officials for their emotional decision making and fear-based propaganda.  

Never in my lifetime have I seen this many people who are pissed off about National, State, County & Local Government policies surrounding Coronavirus. There are so many misguided Government policies to be disappointed in, that I don't even know where to start.  

I have said this from the very beginning of this crisis that our public officials are policy based on emotion and insanely inaccurate expert projections. There is one thing that has remained constant in this information crisis and that is the public data we are receiving is horrendous. There are so many expert data error examples that I don't even know where to start on this rant either. 

No one will admit that the projections health officials & medical tv experts were making in April and March were correct. Where are they now and why aren't we holding them accountable for their crap data? Most Government officials then proceeded to take these expert opinions and projections to feed the fear-mongering news media so they could scare everyone into staying home. 

The USA effectively shutdown the economy with Government policy that was based on false projections. Sweden was the only country that might have been skeptical and actually thought rationally about the outcome of this decision and just asked everyone to change their behavior without staying home. They are in the same position as the USA now but their economy is in way better shape. Short term pain and long term gain.  

Many local USA Government officials I have talked with said it was easy to shut down parks, beaches restaurants, and businesses with County health recommendations. However, the harder part is now convincing everyone to reopen.  

This pandemic or crisis of information started out with stay-at-home orders. We all followed the rules of washing our hands, wearing masks in grocery stores, and pretty much shut down everything in our lives. We all thought that 15 days of following orders to stay at home until Easter was reasonable and most people seemed to comply. The purpose of this was to flatten the curve or prolong the time for more people to get the virus. Aside from NY our hospitals had plenty of capacity and we accomplished this goal. 

Some would argue that staying at home was the only way to flatten the curve. However, some would argue that changes in behavior is what prevented the virus spread not staying home. Doing things like washing hands & social distancing is what flattened the curve. In my opinion, staying at home had little to do with flattening the curve because most of the Coronavirus cases were actually contracted in the home.

Here is an interesting cell phone data tracking study on how many people actually did follow the stay at home orders? The answer was 45-65% of the population actually stayed home. There was a large portion of the population who ignored the orders or were essential workers. The people who didn't stay home likely changed their behavior.  

So what happened on Easter, April 12 and why was the "goal post" get moved further out to April 30? Why did Trump give authority to the State Governors to establish stay at home orders? Why are the decisions to open up so political? Why did State & County health officials have so much power to make decisions?  Why wasn't more of this authority with local City Government officials?

There are so many questions of mismanagement that people like me are becoming activists and are asking practical questions of City and public officials that can't seem to answer. LA County is a great example of 11 million people that has 109 cities within the County. Each city experienced drastically different rates of infection, yet each city was subject to the same LA County draconian rules or recommendations.  

In cities where population density is greater the virus case rates are greater. It's just common sense that is being overlooked and not every city deserved that same rules.

Not letting each city manage and make their own public policy was a huge mistake. Just look at neighboring Orange County which has drastically different politics than LA County. OC is much more conservative and they kept their beaches open and have far fewer restrictions than very liberal LA County. Some Orange County Beach cities even had to file a lawsuit against the State of California to retain their rights.

My gut says if something like this pandemic ever happens again, each city or municipality needs to make its own decisions, what is best for themselves.  A one size fits all public policy is just plain ridiculous and stupid in large cities.  If you don't believe this assumption then you should just stop reading now because you don't understand economics anyway.

Local Government policy is what influences most of your life and why becoming an activist can really influence the policy of resisting change to keep a normal life. Influencing change at the County, State, or Federal Government level is nearly impossible unless you have major power, money, or influence. Most all of the local government policies are likely to affect you as a homeowner, renter, or small business owner.

The term that I keep hearing from the media and Government is "what is the new normal" going to look like? I really can't stand this term because it implies that we need to remake our entire economy or business practices. What happened to Free America, giving people and businesses choices about how to mitigate their own risks?  Has enough time passed to understand the virus and do we really have enough data to evaluate the risks of operating a normal society?  

What if I want to send my child to a normal school setting or have dinner in a sit-down restaurant? Shouldn't I have the choice of whether to take this risk or not?  Yes the virus is contagious but it's not that deadly if you look at the mortality rate of infection?  Walking across the street is probably more dangerous

Most people I speak with are not afraid of getting the virus and many people I know already have had the virus or now have the antibodies. Three people I know had the Coronavirus and also had flu shots. Just a coincidence or are you more susceptible to the virus if you had a flu shot?  Flu shots are an entirely different controversial discussion which you can read here. 

You have the choice to stay at home or send your child to an online school. No one is forcing you to do anything. Government officials have overreached their authority during this crisis and have no logical solutions on how and when to open up the economy or schools.   It is entirely possible that by August and September that we are even talking about the virus in the news because the spread is so rare.  Not a popular view but certainly possible with 3 months of warm weather. 

The only way officials seem to be responding is by legal threats similar to what Tesla's CEO Elon Musk did threatening to pull out of California. Unfortunately, most small businesses don't have the power and the influence that Elon Musk has and so they become easier targets of control without massive financial resources.

One brave city official in Manhattan Beach Suzanne Hadley suggested the following: 
"If I owned a business I would seriously consider just reopening and rolling the dice. Biz owners need to weigh their risk tolerance of legal action against them--as well as the costs of angering some customers and endearing themselves to others. Tough call. As an elected official I would stand with anyone who chose to reopen."
Class action lawsuits are probably going to be the only solution unfortunately for many things to open up and return to normal. City & public officials are way too risk-averse and seem to be taking a wait and see attitude in California instead of a leadership position. 

Public shaming on social media like Facebook seems to be another solution to get lawmakers to take action on certain issues. City council meetings are virtual now on Zoom or GoToMeeting so its harder for people to discuss public issues in person. However, more people are actually listening to these public meetings now and it is easy to share a video or sound clip after a meeting to spread the word on an issue. 

Public schools are going to be a hot topic of activism in the coming months as we get closer to fall. Making sure your school board is looking at all data sources and are not politically motivated in their decision making is going to be incredibly important. I have seen way too much confirmation bias when making decisions about data and we need to make sure there is a healthy PUBLIC discussion or debate on these issues.
