On Saturday, November 6, 2021, the United States Court of Appeals for the Fifth Circuit temporarily suspended the Biden administration’s emergency temporary standard (“OSHA ETS”) for employers with 100 or more employees. As we reported last week, the OSHA ETS mandates that covered employers implement COVID-19 vaccination or regular testing requirements for employees. Citing “grave and constitutional issues,” the three-judge Fifth Circuit panel put the newly issued rule on hold pending further litigation. The stay order has nationwide effect.

While lawsuits challenging the brand-new OSHA ETS were filed by 27 states and private businesses in multiple circuits (including the Sixth Circuit), the conservative Fifth Circuit was the first court to rule on the issue. Challengers argue that the OSHA ETS is illegal, in that it exceeds the authority of, and is not proper subject matter for, the issuing agency (OSHA), and would be counterproductive by further straining an already tight labor market. The Biden administration contends that the OSHA ETS is lawful and necessary to help end the COVID-19 pandemic, and stated it will vigorously defend the ETS in forthcoming court proceedings.

What does this have to do with Biden's mandates?  Because if they fail in the courts, then the legal top cover for the academic institutions, hospitals, and businesses vanish.  The government and Pharma are indemnified. So then the organizations become the bagholders for liability.

This thesis applies more generally to most public policies: the larger public and private institutions are left holding the bag. The upcoming financial crisis will again confirm that.

"It Raises Serious Constitutional Concerns" - Appeals Court Re-Affirms Stay On Biden Vaccine Mandate

One wouldn't know it by scanning the front pages of say WaPo, NYT or Bloomberg where it wasn't even mentioned, but late on Friday a bad week, month, and year for the scrambling Biden administration - which in addition to the recent disaster in Virginia where a public referendum on "wokeness" saw the public overwhelmingly vote down the Democrats' attempt to subvert social norms, is also facing the worst inflationary inferno since Nixon ended the gold standard - after a U.S. appeals court upheld its decision to put on hold Joe Biden's unconstitutional order for companies with 100 workers or more to demand COVID-19 vaccines, rejecting a challenge by his administration.

A three-member panel of the 5th U.S. Circuit Court of Appeals in New Orleans affirmed its ruling despite the Biden administration's position that halting implementation of the vaccine mandate could lead to dozens or even hundreds of deaths. No Nov 6, the Fifth Circuit granted a temporary stay on enforcement of the federal mandate, one day after the rule was announced. In its reaffirmation Friday, the court said the mandate "exposes [petitioners] to severe financial risk" and "threatens to decimate their workforces (and business prospects)."

"The mandate is staggeringly overbroad," the opinion said adding that the vaccine mandate "raises serious constitutional concerns" and "likely exceeds the federal government’s authority."

 "The mandate is a one-size-fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers)," Circuit Court Judge Kurt Engelhardt wrote for the panel.

In its ruling, the Fifth Circuit judges agreed with opponents of vaccine mandates, which have become a deeply controversial topic in the United States (as if the country needed any more of those) - supporters say they are a must to put an end to the nearly two-year coronavirus pandemic, while opponents argue they violate the Constitution and curb individual liberty.

"The public interest is also served by maintaining our constitutional structure and maintaining the liberty of individuals to make intensely personal decisions according to their own convictions - even, or perhaps particularly, when those decisions frustrate government officials," Engelhardt wrote.

At Biden’s orders, the OSHA issued a rule earlier this month requiring U.S. employers with 100 or more workers to ensure their workers are fully vaccinated against COVID-19 or undergoing weekly tests for the virus by Jan 4. Businesses that don’t comply face thousands of dollars in fines.

The rule prompted a slate of legal challenges from at least 27 states as well as business and religious groups who argue the mandate is unconstitutional. Biden and other federal officials argue the mandate is necessary to end the COVID-19 pandemic and fully reopen the economy.

White House officials had no immediate comment on the ruling, which was hailed as a victory by Texas Attorney General Ken Paxton. Texas joined other U.S. states, as well as private employers and religious organizations, in legal challenges to the order.

YouTube has announced it will hide ‘dislikes’ from videos to curb “creator harassment,” with critics pointing out that this is merely a way of removing the huge amount of downvotes on videos posted by the Biden administration.

“YouTube has announced that it’ll be hiding public dislike counts on videos across its site, starting today,” reports The Verge.

“The company says the change is to keep smaller creators from being targeted by dislike attacks or harassment, and to promote “respectful interactions between viewers and creators.” The dislike button will still be there, but it’ll be for private feedback, rather than public shaming.”

Quite how viewer feedback in the form of a thumbs down icon represents “harassment” is anyone’s guess, but the immediate response to the announcement from many was that the Google-owned company was merely moving to protect the Biden White House from ridicule.

“Is this the reason?” asked one respondent, highlighting how Biden speeches and White House press briefings receive massive dislike ratios, sometimes at a rate of ten to one.

It's alleged that someone stole Joe Biden's Daughters Diary (according to this article).  If it is legitimate there are some serious allegations of sexual assault in the diary.  

The FBI raided two addresses in New York on Thursday linked to Project Veritas, as part of a probe into the alleged theft of President Biden's daughter's diary, according to the New York Times, which curiously knew about the raid an hour after it happened, according to Veritas founder James O'Keefe.

Search warrants were executed at a Midtown Manhattan apartment of longtime Veritas employee Spencer Meads.

While Veritas did not publish excerpts of the diary, another conservative outlet ran dozens of handwritten pages from it on October 24, 2020 in the final days of the US presidential election. The website claimed that they received the documents from a whistleblower at another organization that would not publish the information.

According to the report, Project Veritas said it knew the whereabouts of the actual diary and had a recording of Ashley Biden admitting it was hers.

"Late last year, we were approached by tipsters claiming they had a copy of Ashley Biden’s diary," said O'Keefe," adding "the tipsters indicated that they were negotiating with a different media outlet for the payment of monies for the diary."

"At the end of the day, we made the ethical decision that because, in part, we could not determine if the diary was real, if the diary, in fact, belonged to Ashley Biden, or if the contents of the diary occurred, we could not publish the diary and any part thereof."

O'Keefe said that they turned the diary over to law enforcement after Ashley Biden's attorney refused to accept or authenticate it.

The PV founder added in a statement: "We do not know how The New York Times was aware of the execution of a search warrant at our reporter’s home, or the subject matter of the search warrant, as a Grand Jury investigation is secret."

The Times claims that the DOJ has been investigating the matter since October 2020, after a representative from the Biden family reported that several of Ashley Biden's personal items were stolen in a burglary.

Federal Judge Temporarily Bans Biden Admin From Firing Unvaccinated Employees

A federal judge for the district court in Washington, DC, issued a temporary restraining order on Thursday barring the Biden administration from firing both unvaccinated civilians and active-duty military members, Fox News reported.

The order comes after 20 plaintiffs sued the Biden administration for its handling of religious exemptions in its Chinese coronavirus vaccine mandate for federal employees. President Joe Biden issued an executive order on September 9 requiring all employees working for a federal contractor or subcontractor to get vaccinated against the Chinese coronavirus by November 24 to be considered “fully vaccinated” by a December 8, 2021, deadline. The mandate will also order private companies with more than 100 employees to implement required vaccinations or weekly testing for employees.

“None of the civilian employee plaintiffs will be subject to discipline while his or her request for a religious exception is pending,” District Judge Colleen Kollar-Kotelly ordered, according to a Minute Order obtained by Fox News.

In her ruling, Kollar-Kotelly also ordered “active duty military plaintiffs, whose religious exception requests have been denied, will not be disciplined or separated during the pendency of their appeals,” the report states.

The Biden administration must file a supplemental notice by noon on Friday stating if they will agree to comply with the court’s ruling that no plaintiff will be fired or disciplined before the court rules in the case.

The administration has faced intense backlash since Biden announced the mandate, especially since he repeatedly promised to make vaccination voluntary. After much pressure, on Wednesday, the White House Coronavirus Response coordinator, Jeffrey Zients, claimed federal contractors “will not be required to immediate [sic] lay-off workers” and will allow time for “education, counseling and other measures before potentially ending employment,” Reuters reported.

In a statement obtained by Fox News from the plaintiff’s attorney, Michael Yoder, Yoder said the Biden administration has displayed “an unprecedented, cavalier attitude toward the rule of law and an utter ineptitude at basic constitutional contours.”

The statement continued:

Notably, Florida Gov. Ron DeSantis’s (R) administration announced on Thursday that it also filed a lawsuit against the Biden administration for its Chinese coronavirus vaccine mandates, suing both Biden and NASA.

This case is Church v. Biden, No. 1:21-cv-2815 in the United States District Court for the District of Columbia.

In response, Texas Governor Greg Abbott issued an executive order on Monday which prohibits any entity - including private businesses, from imposing vaccine mandates on either employees or customers.

"The COVID-19 vaccine is safe, effective, and our best defense against the virus, but should remain voluntary and never forced," said Abbott in a statement. The rule follows several executive orders Abbott issued over the summer banning local governments and school districts from mask or vaccination mandates - with $1,000 fines for those who fail to comply.

Last week, Southwest announced that its 56,000-person workforce would need to be fully vaccinated with the Covid-19 jab by Dec. 8 in order to remain employed - an announcement which came days after other carriers (including American Airlines, Alaska Airlines and JetBlue Airways) announced similar measures, according to CNBC.

Would an 'Immunity' Mandate Instill More Public Confidence?

Institutional trust is critical for the healthy functioning of government and society. Only 24% percent of Americans actually "trust" the government. Given that dismal level of trust, it is perplexing why the government has decided to move forward with rigid, far-reaching COVID-19 vaccine mandates that will only serve to further erode public confidence.

The Erosion of Trust

In the U.S., we can draw a line from the Vietnam war all the way to the COVID-19 pandemic and easily mark where institutional trust may have been compromised. Within this arc, events and themes like Watergate, the failure of globalization to sustain the middle class, the Iraq war, the 2008 financial crises, racial injustice, and the final culmination of a protracted Afghan war have all played a role. The juxtaposition of far greater institutional transparency and the destabilizing echo chamber of social media are also to blame.

The Organization for Economic Cooperation and Development (OECD) asserts that citizens' trust is derived from an assessment of competence and values within public institutions. The values serve to inform and guide institutional action and they are in part guided by the principles of fairness, openness, and integrity. It therefore seems that the old adage holds: trust is earned not given. The COVID-19 pandemic has laid bare the lack of trust within U.S. institutions. Yes, we are now naked and exposed. We have witnessed, at times, asymmetric and feckless COVID-19 policies lurch from one extreme to the next like a pierced vessel foundering at sea. Some of this is to be expected. It is not easy to make policy decisions based on limited information and especially with a pathogen that doesn't seem to follow the playbook of its predecessors. Or really any playbook at all. This particular virus, while deadly, doesn't seem to incite the same fear that say Ebola or avian H5N1 might. If case fatality rates of COVID-19 were indeed higher, perhaps there would less debate and behaviors would homogeneously fall in line. But this clearly has not been the case.

The Issue With Sweeping Mandates

The Biden administration's decision to mandate vaccination for federal workers and institute other vaccine or testing mandates covering broad swaths of society will only serve to further abrogate institutional trust within the U.S.

The policy lacks the precise language needed to adequately speak to those who understand something about this virus. There now exists the need to make distinctions between categories and eventually degrees of immunity. One can imagine that with continued scientific examination we may perhaps better understand correlates of protection and transmission as they relate to a variety of means of immune acquisition. There will be small differences in immunity imparted by the severity of natural infection, vaccine constructs, vaccine dose, and other factors that may have real-world impact. The simple classification of vaccinated versus unvaccinated lacks the nuance required to satisfy the scientific mind. With many of our top journals reporting COVID-19 publications in open-access format, scientific literacy is at an all-time high. Discourse on virology, epidemiology, and immunology is something that may just as easily be understood by a barista at Starbucks as one of our healthcare professionals.

The Biden policy, unfortunately, continues to ignore other means of acquiring immunity, which may include natural infection and single doses of mRNA vaccine. We cannot turn away from that which has been known all along: this is not a pandemic of the unvaccinated. Many of the unvaccinated have been previously exposed to SARS-CoV-2 or had COVID-19. They have some immunity. This is a pandemic caused by a highly infectious virus that mainly manifests in the immunologically naive. Recent data from Israel continues to build upon the notion that immunity in people who survived a prior SARS-CoV-2 infection is robust and durable -- perhaps even more so than in the unexposed but vaccinated. Ignoring these facts and blindly forging ahead with blunt policies will continue to unravel vital threads of trust that remain in the system.

There is no doubt that vaccination continues to be the single most important strategy to lift us out of this pandemic, and people should not seek out natural immunity. But we must be honest, fair, and open (according to the OECD) in order to maintain trust.

What Biden and others really should require is not proof of vaccination, but rather proof of immunity. This could mean showing a vaccine card, evidence of sufficient antibody levels, or past documented infection. A sufficient antibody level or standard would need to be set and antibody testing would need to be made more accessible.

This more capacious directive of an "immunity mandate" affords a release valve for those who do not subscribe to the orthodoxy of vaccination but have recovered from an infection. It reduces the pressure contained in the system while conserving the safety a vaccine mandate affords. It also provides cover to those who have elected for partial vaccination. This may be a particularly important strategy for children, those previously infected with COVID-19, or those who simply want to watch and wait. There is also precedent. The EU, U.K., and Israel are countries making room to better accommodate natural infection. But most importantly, it signals that we are open to the idea that we are imperfect and don't always have the answers. That the possibility exists for evolving science to allot for more than one answer and that we are not enslaved to the inertia of dogmatism. It is precisely by showing that we are fallible that our policies become more believable and engender ... well, more trust.
