Ron Johnson (R-Wis.) will hold a panel discussion with doctors and medical researchers who have treated COVID-19 vaccine injuries and are researching the safety and efficacy of COVID-19 vaccines, patients who have experienced adverse events due to the COVID-19 vaccine, and vaccine mandates. The senator will speak to his advocacy for early treatment, the importance of American’s health care freedom and recognizing natural immunity, the impacts of mandates on the American workforce and the economy, and the lack of transparency from federal health agencies in response to his COVID-19 oversight requests.

Southwest Employees Protest Vaccine Mandates


One day after hundreds of Southwest Airlines employees protested outside the carrier's Dallas headquarters against the company's pending Covid-19 vaccine mandate, the company caved.

According to CNBC, the airline has scrapped a plan to place unvaxxed employees who have applied for - but not yet received a religious or medical exemption- on unpaid leave starting Dec. 8.

In recent days, executives for both Southwest and American urged employees to apply for exemptions if they can't get vaccinated for a legitimate medical - or sincerely held religious belief.

It’s the second Monday in October and it feels like another dam is breaking. Southwest pilots and FAA traffic controllers walked off the job this weekend, protesting injection mandates and creating aerial chaos with literally thousands of flights canceled. Will Biden fire them all like Reagan did in the 80’s?

Even though there’s more news today than lies in a CDC press conference, a lot of folks are facing imminent injection ultimatum deadlines. Should they resign? Take the jabs? Try to sue? What to do? Today I’m offering suggestions to all those folks who are facing reprehensible employment policies that treat them like cattle. Send to everyone who needs to see this.

Other airlines aren't deviating. United Airlines - which has a 96% vaccination rate among staff, instituted a vaccine mandate in August - one month before the Biden administration issued the Dec. 8 guidance for federal contractors. The company informed staff that they would be placed on unpaid leave if they received exemptions. Several employees sued the company over the decision, and a Ft. Worth, Texas judge issued a temporary restraining order blocking the airline from moving forward with its plan.

American Airlines CEO Doug Parker, meanwhile, met with labor union leaders last Thursday to discuss how to move forward. Airline management "indicated that, unlike the approach taken by United, they were exploring accommodations that would allow employees to continue to work," according to a Monday note by the Association of Professional Flight Attendants, the union that represents American’s mainline cabin crews. "They failed to offer any specifics as to what such accommodations might look like at that time."

Judge Orders United Airlines Not To Put Workers Seeking Vaccine Mandate Exception On Leave

A federal judge ordered United Airlines not to place workers seeking an exemption to the company’s COVID-19 vaccine mandate on unpaid leave.

The employees, who include two pilots and one flight attendant, accused the airline of discrimination against workers who requested accommodation, saying the policy violated the Americans with Disabilities Act and the Civil Rights Act, according to the lawsuit.

Pittman's restraining order, which expires on October 26, is only a temporary halt to United's policy while he hears more arguments on the case. 

The temporary ruling was issued by U.S. District Judge Mark Pittman so workers who filed for an exemption aren’t unduly harmed before he can hear oral arguments in the case.

Six United workers sued the company last month over its plans to put on leave any employees who requested religious or medical exemptions. The suit said the employees were effectively told they’d be terminated if they sought exemptions and alleged that the company was violating Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act, or ADA.

“United’s actions have left Plaintiffs with the impossible choice of either taking the COVID-19 vaccine, at the expense of their religious beliefs and their health, or losing their livelihoods. In doing so, United has violated Title VII and the ADA by failing to engage in the interactive process and provide reasonable accommodations, and also by retaliating against employees who engaged in protected activity,” the suit states.

United and the plaintiffs reached an agreement that the company would not place exempted employees on leave during a Sept. 24 hearing, Pittman said, obviating the need for an immediate ruling. He planned to hear arguments on a motion for a preliminary injunction on Oct. 8 but United filed a partial motion to dismiss, alleging the court lacked jurisdiction over some of the claims.

The hearing was reset to Oct. 13. Ahead of the arguments, Pittman said he concluded it was necessary to issue a temporary restraining order that is effective through Oct. 31.

Absent entry of the order, “the parties’ stipulation will expire before the Court can rule on whether a preliminary injunction is warranted,” the Trump nominee wrote.

“If the parties’ stipulation were to expire without temporary injunctive relief in place, nothing would prevent hundreds of workers from ostensibly either: (1) being compelled to take a vaccination in violation of their religious beliefs or medical restrictions, or (2) being placed on indefinite unpaid leave by United,” he added.

United said earlier this month that 320 workers in the United States, or 0.5 percent of the U.S. workforce, were not in compliance with its COVID-19 vaccine mandate.

United told news outlets after Pittman’s order that “vaccine requirements work and nearly all of United’s U.S. employees have chosen to get a shot.”

“For a number of our employees who were approved for an accommodation, we’re working to put options in place that reduce the risk to their health and safety, including new testing regimens, temporary job reassignments, and masking protocols,” the airline said.

Mark Paoletta, an attorney representing the plaintiffs, told The Epoch Times in an email that United’s “refusal to provide reasonable accommodations to its vaccine mandate violates the federal civil rights protections of our clients, the hard working men and women at United,” adding, “We look forward to our clients’ rights being permanently protected.”

Southwest CEO "I Am Not In Favor of Biden's Vaccine Mandate"

 
 No one loses their job for refusing to get the vaccine. Southwest CEO blames Biden for Vaccine mandate: 

“I’m not in favor of that, never have been. But the executive order from Biden mandates that all federal employees, and then all federal contractors, which covers all the major airlines, have to have a mandate.”

In response, Texas Governor Greg Abbott issued an executive order on Monday which prohibits any entity - including private businesses, from imposing vaccine mandates on either employees or customers.

"The COVID-19 vaccine is safe, effective, and our best defense against the virus, but should remain voluntary and never forced," said Abbott in a statement. The rule follows several executive orders Abbott issued over the summer banning local governments and school districts from mask or vaccination mandates - with $1,000 fines for those who fail to comply.

Last week, Southwest announced that its 56,000-person workforce would need to be fully vaccinated with the Covid-19 jab by Dec. 8 in order to remain employed - an announcement which came days after other carriers (including American Airlines, Alaska Airlines and JetBlue Airways) announced similar measures, according to CNBC.

Benefis Health Systems announced such a mandate earlier this year that had to be rescinded once Governor Gianforte signed a new law in may stating that’s not allowed.

State health professionals said it’s a “travesty” that this is no longer an option for employers as active cases are nearing 3,500.

While many large companies across the U.S. have announced that COVID-19 vaccines will be required for their employees to return to work in person, there is one state where such requirements are banned: Montana.

Under a new law passed by the state’s Republican-controlled Legislature earlier this year, requiring vaccines as a condition for employment is deemed “discrimination” and a violation of the state’s human rights laws.

Montana is the only state in the U.S. with a law like this for private employers, said Hemi Tewarson, executive director of the National Academy for State Health Policy.

GOP lawmakers who supported the bill in the state Legislature said it was needed in response to employers “coercing” employees to get vaccinations under threat of termination. Some of the loudest supporters of the bill were employees of Benefis Health System in Great Falls who were told earlier this year that COVID-19 vaccines would be necessary to keep their jobs.

Benefis was forced to backtrack on that plan when the law was signed by Gov. Greg Gianforte in May.

Gianforte, a former business executive who founded and ran a technology company, gave the bill the green light after changing it to allow health care facilities to require unvaccinated workers and those who refuse to disclose their vaccination status to wear masks and take other precautions.

He stood behind the law this week amid heightened scrutiny.

“While the governor continues to encourage Montanans to receive safe and effective vaccines, doing so is voluntary and no individual should face discrimination based on vaccination status,” Brooke Stroyke, a spokesperson for Gianforte, said in an email.

While the list of national corporations requiring vaccines of their employees who want to return to work in-person continues to grow, which now includes Google, Facebook, Walmart, and United Airlines, businesses in Montana don’t have that option.

“Most (businesses) feel like their hands are tied right now,” said Mike Rooney, operations director for Downtown Helena Incorporated, an organization that represents businesses in downtown Helena. “Some would definitely be very supportive of a vaccination requirement or a mask requirement.”

The Montana Hospital Association opposed the law before it took effect, warning that it would make it harder for the state to meet its need for medical services. Now, the association is saying their fears may come to fruition.

Dr. Neil Ku, an epidemiologist at Billings Clinic who sits on the board of the Society for Healthcare Epidemiology of America, said the law sets Montana apart in conversations about how to combat the coronavirus.

“It is very very difficult for me to participate in the conversation when everywhere in the country can talk about vaccinating their employees but I can’t,” Ku said.

Hospitals in Montana until recently required their employees to get most vaccines approved by the Centers for Disease Control, including the annual flu shot, providing an avenue for employees to opt-out for medical or religious reasons. Now, that is no longer possible, leaving both workers and patients vulnerable.

Across the U.S., 60% of those eligible are vaccinated against the COVID-19. In Montana, that number is 49%.

In Montana hospitals, employees are vaccinated at a higher rate, but without a requirement, patients must contend with added risk to their health when seeking care.

“It holds us out as an anomaly against the rest of the nation,” said Rich Rasmussen, president of the Montana Hospital Association. “We have to rely on recruiting from out of state. The rest of the nation is looking at us and they are saying, ‘I don’t know if I want to practice in Montana, because of their approach to patient and employee safety as it relates to vaccinations.’"

Facing the specter of a coronavirus surge, Montana employers are left to navigate their way to keep employees safe and the doors open.

“A lot of businesses feel like they don’t have the support right now, so for them, it’s about how do they figure it out on their own end,” Rooney said.
